Terms of Service

These Terms of Service ("Terms") govern your access to and use of CodeConfirmed, a product of Arrington Innovative Solutions, LLC ("AIS", "we", "our", or "us"). By creating an account or using our services, you agree to be bound by these Terms.

1. Description of Service

CodeConfirmed is a SaaS platform that provides AI-powered test coverage analysis, test generation, test plan management, and related tools for software development teams. The service includes GitHub repository integration, AI scanning, coverage scoring, and the Radar AI assistant.

2. Account Registration

To use CodeConfirmed, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your password and for all activities that occur under your account.

3. Subscription Plans and Billing

CodeConfirmed offers Free, Starter, Pro, and Business subscription tiers. Paid subscriptions are billed monthly or annually to the organization ("org") that owns the subscription. All fees are non-refundable except as required by applicable law. Scan credit top-ups are one-time purchases and are non-refundable once used.

We reserve the right to change pricing with 30 days' notice. Price changes do not apply retroactively to the current billing period.

4. Organization and Team Usage

Each subscription is tied to an organization. The organization owner controls billing, member access, and data. Team members share the organization's scan credits and feature limits. When a member leaves an organization, their access to that organization's data is immediately revoked.

5. GitHub Integration

CodeConfirmed's GitHub integration provides read-only access to your repositories. We will never write to, push to, or modify your code. Your source code is sent to AI models (Anthropic Claude) solely to generate test suggestions and is not stored after analysis completes. You may disconnect your repository at any time, which immediately revokes all access.

6. AI-Generated Content

Test cases, coverage analyses, scripts, and recommendations generated by CodeConfirmed's AI are provided as suggestions. You are responsible for reviewing and validating all AI-generated content before use in production. We do not guarantee the accuracy, completeness, or fitness for purpose of AI-generated tests.

7. Data Usage and Privacy

Your use of CodeConfirmed is also governed by our Privacy Policy. We collect and process data as described therein. Your project data, test results, and scan history are stored securely and are only accessible to members of your organization.

8. Acceptable Use

You agree not to:

Use the service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to any part of the service
Interfere with or disrupt the service or its infrastructure
Reverse engineer, decompile, or disassemble any part of the service
Use automated tools to scrape, mine, or extract data from the service beyond normal API usage
Share your account credentials with unauthorized parties

9. Intellectual Property

CodeConfirmed, including its software, design, logos, and documentation, is the intellectual property of Arrington Innovative Solutions, LLC. You retain ownership of your project data, test content, and any code you connect via GitHub. AI-generated test suggestions become your property once generated.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. Business plan customers receive SLA guarantees as specified in their service agreement.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period. We may terminate or suspend your account for violation of these Terms. Upon termination, your data will be retained for 30 days, after which it may be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
